Microsoft facing another lawsuit

Ring of Death!

A little over a year later Microsoft is facing another class action lawsuit. The first time around Robert Byers claimed that Microsoft knowingly released faulty consoles to beat Sony out of the gate, although there were a lot of inconsistent claims with the first suit that were never proved and quickly put down.

This time around Kevin Ray of California claims that the Fall 2006 Update on November 1st literally “bricked” his system. Further strengthening his case is Xbox’s own “Major Nelson” who openly acknowledged a problem with the November 1st update, stating that Microsoft was taking care of the problems. Microsoft is also refusing to replace his “bricked” system and now the plaintiff is seeking $5 million in damages. I think that’s a little extravagant but my 360 has always worked for me. What do you think?

    One word: loser. Five MILLION dollars because his console is bricked? Give me a break.

    400 max + court fees if he wins. If he gets 5 million I’m gonna sue McDonalds for their burger not tasting right next time ones bad.

    I’d say if it was the update that screwed his box, then they could at least replace it but if not, I’d say he doesn’t get a dime.

    The March 06 update bricked my console. But MS replaced it and it’s been working great since. Now I’m trying to get my MSP back for the XBLA games that don’t work anymore because of the console change… stupid policy!

    Phone up XBox.com and get them to change the Xbox serial number on your Live account and that’ll sort out your broken XBLA games.

    I’ve called them many times and they’ve always said they have to authorize the points to be refunded to a new silver account that will buy the games for that console. Then the original gold account will be able to access the full versions offline. It’s f’d up.

    I’m somewhat tired of all the ‘well my 360 didn’t brick so this guy in california needs to settle down.’ I’d be the same way if my Xbox 360 console purchased in February of 2005 didn’t brick due to the Fall 2006 Update/Virus, but that isn’t the case. For my 360 -did- brick, but instead of confronting Microsoft about it like I should have done, I just returned it to Circuit City and got my money back.

    Here’s hoping that MS atleast replaces all affected 360’s for free. If there were an easy way to join in the lawsuit since mine was affected as well I would, but I lack the knowledge in the court system.

    I hope he wins, it will teach M$ not to screw with the little guys, and if he does win, than maybe next time someone calls in with a problem the will LIESTEN and do something about i.
