Wow this is really heating up. Epic Games has sued Silicon Knights in an attempt to both protect their Unreal 3 code, and get over $650,000 for the damages this suit has caused them. Silicon Knights stated when this all began that they wanted to use the Unreal 3 tech in the creation of their Too Human engine which they don’t think they need to pay for, because of the time it took for Epic to finish the engine. But this voids their contract in two ways. First they promised that they would use Unreal 3 in the development of all their 360, PS3, and PC games. By making their own engine they are voiding their agreement and still using UE3 code. Also they are making a game for Sega which does not use Unreal 3, this also voids their agreement for the same reason.
Silicon Knights seems to be between a rock and a hard place with all the contracts they have signed to get the Unreal 3 Engine in their games. I wonder if the case will be televised on Court TV or Xbox Live.
